Ticketed events booking terms and conditions

These Terms set out the basis on which we will accept bookings for an activity, workshop or event (herein referred to as an Activity). If you do not agree with these Terms, then you should not proceed with your application (“Application”) to make a booking (“Booking”).  By making a Booking for an Activity you accept these Terms and give consent for your child to participate. You should save a copy of these Terms for future reference.  We amend these Terms from time to time and every time you make a Booking you should check these Terms to ensure you understand the terms that apply at that time.

COVID secure events

Do not enter our buildings or attend events/activities if you have coronavirus symptoms:

  • a high temperature
  • a new, continuous cough
  • A loss of, or change to, your sense smell or taste

Acceptance of your booking

The decision to accept your Application shall be at our sole discretion and a Booking shall not be made until you have received an email from us confirming the Booking.

We have the right to refuse any Application. We reserve the right to verify, or require proof of all information given in the Application. Any fraudulent or wrongful information given in order to obtain a Booking could result in the cancellation of your Booking.

We only accept Bookings by people over the age of 18.  Bookings for Activities to be undertaken by children can only be made by the parent or legal guardian of those children.  By submitting the Application you warrant that you are aged 18 or over and that if you are Booking an Activity for a child, you are the parent or legal guardian of that child.

Subject to the Booking being confirmed and subject to you paying the Fee, you have the right to undertake the Activity at the time or at the times set out in the Application.

We will not refund the Fee if you choose not to undertake the Activity or attend any session.

The Activity

Subject to the remainder of these Terms, we will provide the Activity as set out in the Application.

We will use our reasonable efforts to ensure that each Activity starts on time, but times shall be estimates only.

You will provide all information and cooperation in relation to the Services that we reasonably require from time to time.

If there is any problem with the Services you should let us know as soon as reasonably possible and give us a reasonable opportunity to correct any problem within a reasonable time.

Performance Activity

In respect of any Activity which shall be a performance:

Audience members may be filmed, photographed or recorded for broadcast or security reasons.

Every member of the audience must possess a valid ticket.

Tickets cannot be resold for commercial gain.  We may cancel tickets and refuse entry if we have reason to believe this condition has been breached

It is the responsibility of the ticket holder to check any ticket restrictions prior to purchase.

Some performances may have special conditions which will be published separately.

Limitation of liability

We are responsible to you for any loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence but we are not responsible for loss or damage caused by other factors including loss or damage caused by you or a third party not involved on our behalf with the Activity.

You bring all personal belongings to the Activity at your own risk. We accept no liability for loss or damage to property of customers/participants which is not caused by the negligence of us or our employees.

You park your car where the Activity takes place at your own risk. We accept no liability for loss or damage to your car and its contents which is not caused by the negligence of us or our employees.

Nothing in these Terms will exclude or limit our liability for fraud or death or personal injury caused by our negligence.

We do not accept responsibility for attendees outside the hours of the session. You should not leave your child/ren unaccompanied until the activity staff arrive or after the session has ended.

Physical health of participant

It is your responsibility to make sure that the person taking part in the Activity is fit and able to do so.
If you have any concerns about you or your children’s physical condition, you must get medical advice before attending undertaking Activity. It is your responsibility at the time of booking to declare anything that may affect your or your child’s/children’s participation in the Activity including medical conditions and/or special requirement.

We may refuse you access to the Activity or prevent you or your child/children from taking part in the Activity if we consider the Activity could put your or their health at risk, including the suspected effects of drug or alcohol misuse.

Payment

Your booking is not confirmed until payment has been received and acknowledged in full.

In order to be eligible for Passport to Leisure discounted activity/events a valid Passport to Leisure card must be produced at time of booking and at the Activity.

Refunds and Cancellations

By Us

In exceptional circumstances, it may be necessary to change the format of an Activity on the day. We will endeavour to inform you or, in respect of a Booking for a child, inform the parents/guardians prior to the commencement of the session.

We reserve the right to cancel the Booking or any session with immediate effect by giving you written or verbal notice.

We may cancel the Activity if we are affected by something outside our control including but not limited to weather, staff absence.

We will not be responsible for any loss you suffer if we are unable to provide the Services due to something outside our control.

If something outside our control prevents us from providing all or any part of the Activity we will notify you as soon as reasonably possible and, subject to availability, offer to provide you with substitute services. Where we cannot provide you a substitute Activity, we will refund to you the full or part of the payment applicable to any Activity which you have not received.

By you

The booking of an Activity is considered to be a commitment to attend.

You may cancel a Booking at any time by giving us written notice (an e-mail is sufficient).  Refunds will not be given unless the Activity is cancelled by us or rescheduled.

Suitable clothing

Due to the nature of some of the Activities we recommend that you and/or your child wear appropriate clothing and sensible footwear.  We also recommend that you bring suncream and insect repellent where appropriate (please note that our activity leaders will not be able to apply this suncream or insect repellent to your child), and food and drink as appropriate for the Activity. Occasional Activities take place in the dark and therefore persons taking part in these Activities should provide a torch or similar.

Expected behaviour

Smoking will not be permitted any where during our Activity.

If at any time we determine that you are not behaving in a responsible manner or that you are not showing respect to other people and their possessions you will be asked to leave & no refunds will be given. If your child’s behaviour is causing disruption to the Activity to the detriment of other attendees, remove your child from the Activity, or if the behaviour is considered sufficiently serious (e.g. physical or verbal abuse of other attendees or member s of staff) we may contact you to ask you to collect your child and discuss with you any future planned attendance. You must collect your child within 30 minutes of being asked by us to do so. Failure to collect your child when asked will result in all other Bookings for your child being cancelled with no refund payable.

By agreeing to these terms and conditions your further indemnify the organisers/promoters and the venue from and against all legal liability in respect of any costs of claims, damages, penalties, actions, proceedings, suits, losses or expenses in respect of or arising from injury to or death of any person or damage to any property arising from your participation in the chosen event.

Passport to Leisure

Passport to Leisure holders will be entitled to a 20% discount on evening ticketed events. Eligibility for this discount requires Passport to Leisure holders to present their card in person at the event or to provide details of the membership number.
